Ubisoft steals from Pirates!

Ubisoft, in a desperate attempt to address an issue with the Direct2Drive version of their Rainbow Six: Vegas 2, downloaded a crack and added it to their own Patch V1.03.
Too bad their community checks each file to see what’s changed.
Basically, Ubisoft took infamous hacker Reloaded’s No-CD crack for their game, and used that to fix the CD check of the downloaded installer of the game.
What I want to know is, can a pirate (Reloaded) sue the company he stole from for stealing from him what he originally stole from them?
Nose bleed.
Anyway, you can amuse yourself in the Ubisoft forums . They closed the thread btw, ending with this statement from the Ubisoft Community Manager:
“I’d say this discussion has run its course, as such it is now locked.
The file was removed from the site over a week ago now and the matter is being thoroughly investigated by senior tech support managers here at Ubisoft.
Needless to say we do not support or condone copy protection circumvention methods like this and this particular incident is in direct conflict with Ubisoft’s policies.”
